Essential Legal Inquiries
Under Ontario's Family Law Act, both legally married spouses possess an equal right of possession to the matrimonial home regardless of whose name is on the deed. Additionally, unlike other assets, the full equity of the home is included in the equalization calculation without deducting its pre-marriage value if owned on the marriage date.
